Quà © es el programa de Comunidades Seguras Comunidades Seguras es un programa del gobierno federal de colaboracià ³n con autoridades locales y estatales para identificar inmigrantes para proceder a su remocià ³n inmediata de los Estados Unidos o al inicio de un procedimiento de deportacià ³n. Las razones por las que el migrante puede verse en ese problema pueden ser variadas, desde estar en el paà s como indocumentado a haber cometido violaciones migratorias o delitos oà faltas penales. En este artà culo se explica cà ³mo funciona este programa, por quà © tiene fieros defensores y crà ticos, cul es la relacià ³n de Comunidades Seguras con las ciudades santuario y quà © se puede hacer. Cmo funciona el programa Comunidades Seguras El funcionamiento es realmente sencillo. En Estados Unidos cuando una persona es arrestada o detenida se le toman las huellas digitales, conocidas en algunos paà ses como dactilares. A continuacià ³n esa informacià ³n se le envà a al FBI. El FBI las compara contra varias bases de datos, por ejemplo, IAFIS, donde estn fichadas personas con pasado delictivo. Adems, las compara con bases de datos de otras agencias como IDENT, del Departamento de Seguridad Interna (DHS, por sus siglas en inglà ©s) en la que se guarda toda la informacià ³n disponible sobre inmigrantes, sobre criminales y sobre personas consideradas terroristas o sospechosas de serlo. Asimismo, tambià ©n se comparan esas huellas dactilares con la base de datosà de los oficiales de migracià ³n, como por ejemplo US-VISIT, con las que controlan losà pasos fronterizos terrestres, puertos y aeropuertos. Si el resultado es que la persona es inmigrante y tiene rà ©cord criminal o una orden de deportacià ³n pendiente o se sospecha que est en el paà s ilegalmente entonces se considera que se produce un à ¨hità ¨. Aclarar que se puede creer que una persona est como indocumentada tanto porque no aparece rà ©cord de su ingreso legal y se cree que es extranjera o porque es evidente que ingresà ³ legalmente pero no ha salido a tiempo.à Si se produce ese à ¨hità ¨, es decir, una coincidencia de interà ©s para Inmigracià ³n, entonces el FBI lo notifica tanto a la autoridad que tiene a la persona arrestada o detenida como al Centro de Apoyo para el Cumplimiento de la Ley (LESC, por sus siglas en inglà ©s), que es un departamento dentro de ICE. A partir de ahà , ICE analiza la situacià ³n y decide, segà ºn lo que considere prioritario, quà © hacer. Puede decidir emitir un detainer, tambià ©n conocido como hold. Esto quiere decir que se solicita que se retenga al detenido por 48 horas ms a partir del dà a que deba ser liberado, con el objetivo de darle tiempo al ICE de hacerse cargo. En ese plazo de 48 horas no se incluyen sbados, domingos ni feriados. Adems, en la actualidad los detainer van acompaà ±ados de una orden (warrant, por su nombre en inglà ©s), que pueden ser de dos clases: para remocià ³n/deportacià ³n o para arresto. A partir de ahà , si la autoridad que recibe el detainer decide cumplirlo, entregar al detenido a las autoridades migratorias, que segà ºn el caso, procedern a su deportacià ³n inmediata o iniciarnà un procedimiento judicial de deportacià ³n. Argumentos a favor y en contra de Comunidades Seguras Los defensores de este programa consideran que es una gran herramienta para deportar a migrantes, particularmente los que tienen un historial comoà criminales violentos.à Sin embargo, un estudio de Transactional Records Access Clearinghouse de la Universidad de Syracuse argumenta que en la actualidad no hay datos pà ºblicos de cuntos detainers se emiten y que no est nada claro cuntos son causa de deportacià ³n. Es ms, aseguran que solamente un porcentaje mà nimo de las deportaciones tienen su origen en un detainer emitido dentro del marco de Comunidades Seguras. Entre los argumentos en contra de Comunidades Seguras se citan, entre otros, que rompe la confianza entre la policà a y la comunidad y hace que muchos delitos no se reporten. Adems, se afirma que da lugar a la deportacià ³n elevada de inmigrantes con rà ©cord criminal limpio, cuyo à ºnico problema es que estn en el paà s como indocumentados. Finalmente, tambià ©n se aduce que Comunidades Seguras es un gasto excesivo para las municipalidades. Lo cierto es que este programa ha tenido un historial conflictivo. Fue creado en el aà ±o 2008 por el presidente George W. Bush en el condado de Harris en Texas y de ahà se extendià ³ progresivamente por todo el paà s, incluidos sus territorios como por ejemplo Puerto Rico, bajo el mandato de Obama. Bajo ese presidente se establecieron prioridades en su aplicacià ³n y, finalmente, se suspendià ³ su aplicacià ³n. Sin embargo, la llegada de Donald Trump a la Casa Blanca supuso su activacià ³n mediante orden ejecutiva del 25 de enero de 2017. En la actualidad sigue siendo un programa muy criticado, que causa miedo entre la comunidad migrante y que ha dado lugar a oposicià ³n de municipios e incluso estados en la forma de lo que se conoce como ciudades santuario. Qu son las ciudades santuario y cmo se relacionan con el programa Comunidades Seguras Uno de los temas migratorios ms controvertidos y debatidos en los Estados Unidos es el de las ciudades santuario, a las que sus crà ticos acusan de no cumplir con las leyes migratorias.à Para entender este asunto lo primero es saber de quà © realmente se est hablando. Hay que partir de que no hay una definicià ³n legal de lo que es una ciudad santuario, pero puede entenderse como tal a aquellaà jurisdiccià ³n -estado, condado o ciudad, que limita su colaboracià ³n con las autoridades federales en materia de inmigracià ³n. Ese là mite puede estar declarado pà ºblicamente o puede ser algo que simplemente ocurre, es decir, es un asunto informal. En cuanto a las formas que puede tomar la falta de colaboracià ³n, à ©stas pueden ser muy variadas. Por ejemplo, la prohibicià ³n de que un funcionario pà ºblico municipal pregunte sobre el estatus migratorio de una persona. Otro ejemplo comà ºn es el de no compartir informacià ³n sobre datos en los que conste la situacià ³n de indocumentado de un migrante como es el caso de la Ciudad de Nueva York que no comparte lo que sabe sobre los solicitantes del I.D. de la ciudad. Pero quiz el ejemplo ms conocido y el que levanta ms crà ticas y que est directamente relacionado con el programa de Comunidades Segurasà es el de no cumplir con las peticiones de deteiners que emite el ICE solicitando a otra jurisdiccià ³n que retenga, por un plazo de 48 horas, a un migrante que tiene arrestado o detenido por otro asunto no relacionado con temas migratorios. Algunas ciudades santuario incumplen los deteiners siempre mientras que otras los ejecutan cuando el objeto del deteiner es un inmigrante con un delito en su rà ©cord.à En la actualidad, segà ºn el Inmigrant Legal Resource Center, hay ms de 300 jurisdicciones que en algà ºn grado pueden ser consideradas como ciudades santuario y han sido amenazadas con la retirada de fondos federales, en particular de subvenciones del Departamento de Justicia. Sin embargo, no es seguro de que se pueda aplicar este castigo y en la fecha en la que se escribe este artà culo est inmerso en una batalla legal de la que se desconoce cà ³mo puede finalizar. Qu se puede hacer Lo cierto es que estamos viviendo una à ©poca que causa gran ansiedad entre la comunidad migrante. Los residentes permanentes deberà an considerar convertirse en ciudadanos mediante naturalizacià ³n y evitar cualquier tipo de problemas que pueden dar lugar a su deportacià ³n. Los extranjeros con visa deben conocer los tà ©rminos de la misma y evitar violaciones migratorias. Y en cuanto a los migrantes indocumentados deben informarse sobre si existe alguna posibilidad real para arreglar su situacià ³n, deben conocer sus derechos si son parados por la autoridad y no mostrar ninguna documentacià ³n que pueda dar lugar a revelar que estatus, como por ejemplo la matrà cula consular. Finalmente, es siempre aconsejable que tengan a mano el telà ©fono de un abogado migratorio u organizacià ³n de apoyo a inmigrantes de confianza para comunicarse en el caso de problemas. Estar informados es siempre la mejor arma para estar preparados, defender los derechos que se tienen y evitar ser và ctimas de fraude por parte de personas inescrupulosas que toman ventaja de la situacià ³n de miedo en la que muchos migrantes viven en la actualidad. They establish a clear educational vision and consequent shared mission; identify goals or objectives that enable them to achieve that mission and thereby realise that vision; audit themselves, thereby identifying areas for improvement; and develop and implement educational programs on the basis of leadership 57 that audit that address areas for improvement n ways that help them achieve the mission. That process, much of the literature suggests, is recursive or cyclical. The key in the school improvement literature seems to be that thereââ¬â¢s a first step, identifying your vision and shared mission, that then informs the next step, the planning process of identifying goals or objectives aligned with the vision and mission. Whether you look at the management literature or the school improvement literature, at its simplest, goal setting is a way of asking what do we want, do we have what we need so that we can develop and implement what we plan, do our various goals elate to one another or are any in conflict, and is there anything weââ¬â¢ve overlooked, including internal and external blockers? There, in 200 or so words, you have the whole easy-peasy school improvement planning story, and can stop reading and go and get that coffee right now. Or not. The problem, if youââ¬â¢re still reading, is that planning and goal setting can sometimes lead to fragmented, uncoordinated programs with conflicting objectives that actually work against one another. Yes, setting specific, challenging goals, and developing and implementing educational programs to meet them can drive school mprovement, but as Adam Galinsky, author with Lisa Ordonez, Maurice Schweitzer and Max Bazerman of ââ¬ËGoals gone wild,ââ¬â¢ in the 58 teacher june/july 2009 Journal of the Academy of Management Perspectives, told the Boston Globeââ¬â¢s Drake Bennett, goal setting ââ¬Ëcan lead to crazy behaviours to get people to achieve them. ââ¬â¢ ââ¬ËWe contend,ââ¬â¢ write Ordonez, Schweitzer, Galinsky and Bazerman in ââ¬ËGoals gone wild,ââ¬â¢ ââ¬Ëthat goal setting has been over- prescribed. In particular, we argue that goal setting has powerful and predictable side effects. Rather than being offered as an ââ¬Å"over-the-counterâ⬠salve for boosting performance, oal setting should be prescribed selectively, presented with a warning label and closely monitored. ââ¬â¢ Tunnel vision To be fair, Ordonez, Schweitzer, Galinsky and Bazerman have their eyes set on performance management, and its tendency to an outcome orientation like a defined sales target, say, or reduced time spent on a process, rather than school improvement, and its tendency to the systemic development and implementation of programs. Nonetheless, people in a school who want to improve it will end up setting, or having set for them, some kind of performanceoriented goal. The message from Ordonez, Schweitzer, Galinsky and Bazerman is that they should pursue that goal with care. Letââ¬â¢s consider why goals, as Ordonez and colleagues put it, go wild. The first reason, they argue, is that a goal might be inappropriate or so specific that in pursuing it, people ignore important elements of their behaviour, and maybe even their attitudes and values, that are not specified by the goal. ââ¬ËSuppose that a university department bases tenure decisions primarily on the number of articles that (academics) publish,ââ¬â¢ they write. ââ¬ËThis goal will motivate (the academics) to accomplish the narrow objective of publishing articles. Other important objectives, however, such as research impact, teaching and service, may suffer. ââ¬â¢ Worse, say Ordonez and colleagues, referring to Barry Staw and Richard Boettgerââ¬â¢s ââ¬ËTask revision: A neglected form of work performanceââ¬â¢ in the Academy of Management Journal, goals can give us tunnel vision. In their study on the effects of goals, Staw and Boettger asked students to proofread a paragraph that contained both grammatical and content errors. They found that those asked simply to ââ¬Ëdo your bestââ¬â¢ corrected both grammatical and content errors, while those who were asked specifically to correct grammar gnored content, and those who were asked specifically to correct content ignored grammar. The reason? Goals ââ¬Ëinform the individual about what behaviour is valued and appropriate,ââ¬â¢ argue Staw and Boettger. The goal-setting problem, Ordonez and colleagues add, is that when we plan we tend to latch on to specific, measurable standards rather than complex sets of behaviours, and the attitudes and values that underlie them, precisely because specific standards are easy to measure and complex sets of behaviours are not. Command performance The goal-setting problem, essentially, depends n whether a goal is set by command or by consultation, negotiation or ââ¬â horror ââ¬â genuine collaboration. Goals set by command are, by definition, set by those with the power, whether you like it or not, to set them. The risk of such goal setting is that, first, it may lead to goals that are inappropriate or overly specific and, second, that leaders and their followers can be prone to what could be called target fixation or what Christopher Kayes, calls ââ¬Ëdestructive goal pursuitââ¬â¢ in Destructive Goal Pursuit: The Mount Everest disaster, to which Ordonez and colleagues also refer. As they note, ââ¬ËKayes identifies warning signs of leaders who have become excessively fixated on goals. These occur in leaders who express narrowly- defined goals, associate goals with destiny, express an idealised future, offer goal-driven justifications, face public expectations and attempt to engage in face-saving behaviour. ââ¬â¢ Itââ¬â¢s a useful checklist to use to audit yourself or a leader in your institution, but remember, we tend to latch on to specific measurable things rather than complex sets of behaviours, and the attitudes and values that underlie them, precisely The goal-setting problem s that when we plan we tend to latch on to specific, measurable standards because specific standards are easy to measure. leadership 59 because the specifics are easy to measure and complex sets of behaviours are not. Performance anxiety Of course, one of the main planks of the education policy of this and the previous Commonwealth government is the standards agenda ââ¬â the benchmarking of student achievement outcomes, which educators and schools then strive to achieve, and which at their worst could end up as ââ¬Ëleague tables. ââ¬â¢ Whether youââ¬â¢re a fan of the standards agenda or not, itââ¬â¢s clearly the mother of all oals in Australian education, and worth considering in terms of goal setting. Ordonez and colleagues have some interesting observations to make, particularly about what they call the serious side-effects of setting challenging or so-called stretch goals. These, they argue, can lead people to choose riskier strategies and to cheat, and can create a culture of competition that erodes cooperation. On ethics, they argue, ââ¬ËThe interplay between organisational culture and goal setting is particularly important. An ethical organisational culture can rein in the harmful effects of goal setting, but at the same ime, the use of goals can influence organisational culture. Specifically, the use of goal setting, like ââ¬Å"management by objectives,â⬠creates a focus on ends rather than means. Goal setting impedes ethical decision making by making it harder for employees to recognise ethical issues and easier for them to rationalise unethical behaviour. Given that small actions within an organisation can have broad implications for organisational culture, we postulate that aggressive goal setting within an organisation will foster an organisational climate ripe for unethical behaviour. That is, not only does goal setting irectly motivate unethical behaviour, but its introduction may also motivate unethical behaviour indirectly by subtly altering an organisationââ¬â¢s culture. ââ¬â¢ Handle with care If the bad news of the government-mandated standards agenda is that thereââ¬â¢s a risk of a form of goal setting that creates a focus on ends rather than means, the good news for schools is that the school-improvement literature puts a premium on one thing thatââ¬â¢s evident in the first 200 words of this story: collegiality. With any luck, your school- improvement planning process and the goals that you consequently set are the result of onsultation, negotiation and collaboration, not command and, if they are, chances are yours are learning goals, not performance targets. As Ordonez and colleagues observe, performance goals inhibit learning. ââ¬ËWhen individuals face a complex task, specific, challenging goals may inhibit learning from experience and degrade performance compared to exhortations to ââ¬Å"do your best. â⬠An individual who is narrowly focused on a performance goal will be less likely to try alternative methods that could help her learn how to perform a task. Overall, the narrow focus of specific goals can inspire erformance, but prevent learning. ââ¬â¢ As Edwin Locke and Gary Latham recommend in ââ¬ËBuilding a practically useful theory of goal setting and task motivation: A 35-year odysseyââ¬â¢ in American Psychologist, we should be setting ââ¬Ëlearning goalsââ¬â¢ in complex situations rather than ââ¬Ëperformance goals. ââ¬â¢ The problem, as Ordonez and colleagues note, is that, ââ¬ËIn practice, however, managers may have trouble determining when a task is complex enough to warrant a learning, rather than a performance, goal. Ludwig van Beethoven was, and remains today, an Olympian figure in the history of classical music. His influence on the last 150 years of music is unequalled; while generaly a member of the Classicist fold, he was in fact the first Romantic, and pre-figured virtually all music that followed the Romantic era as well. Perhaps no other composer in history wrote music of such exhilarating power and expressiveness; certainly no other composer did so against greater odds. Beethoven was born in Bonn in 1770. His father, a music enthusiast, dreamed of molding his son into the next Mozart. Beethoven never exhibited the astonishing prodigy characteristics of his predecessor, but he was unusually talented, learning the piano, organ and violin at an early age. At 14, he was already proficient enough on the organ to receive a professional appointment. His family life was chaotic; his father was an alcoholic, and his mother died suddenly when he was only 17. After that tragedy, his domestic situation declined even more, and this condition - combined with support from Haydn - compelled him to leave home in 1790 and travel to Vienna to study composition. In Vienna, Beethoven first studied with Haydn, but eventually became frustrated with that great composer's teaching methods, moving on to study with other composers. He performed frequently in salons of wealthy nobility, but strangely enough, did not perform in public until he was 25. But from this point onward, he was embraced by both the common folk and the aristocracy of Vienna, so much so that he never had to rely on court appointments or private patrons for his livelihood. He did receive stipends from admirers and friends, but he remained independent of the shackles of conditional patronage that frustrated so many of his contemporaries. Beethoven was lucky in one sense; he rose to prominence in the musical world at a time when social strata were becoming more flexible, and the emerging power of the middle class provided him many opportunities for performances of his music for public audiences. This, combined with lucrative publishing arrangements, allowed him to live relatively well. He was not ignorant of the benefits of aristocratic support, however; throughout his career, he cultivated a romantic, moody and mercurial image with the upper class and leveraged this persona to achieve a social status equal to the Viennese nobility. Beethoven was a master symphonist - the master symphonist in the eyes of most musicians and composers. His compositions for orchestra were revolutionary in his day; while he adhered to Classical musical forms, his melodies and orchestration were of such unprecedented power and beauty that they astonished even the most hardened listeners.
